Legal Responsibility
By participating in a charter aboard the Galeon 40 Fly, guests acknowledge and accept full responsibility for their actions and conduct during the charter. The charter operator shall not be held responsible for personal belongings, injuries, or losses resulting from guest actions or negligence.
Limitation of Liability
To the fullest extent permitted by law, the charter operator, owner, and captain shall not be liable for any direct, indirect, incidental, or consequential damages arising from participation in the charter, except where required by applicable law.
Risks Associated with Boating
Boating and water-related activities involve inherent risks, including but not limited to changing weather conditions, sea state, movement of the vessel, and water activities. Guests voluntarily assume all risks associated with being onboard and participating in the charter.
Guest Conduct
Guests are expected to behave responsibly and respectfully at all times. Unsafe behavior, disorderly conduct, or violation of maritime laws may result in immediate termination of the charter without refund.
Alcohol Policy
Alcohol consumption is permitted for guests of legal drinking age. Excessive intoxication, unsafe behavior, or violation of safety instructions related to alcohol consumption will not be tolerated and may result in early termination of the charter without refund.
Children Onboard
Children are welcome onboard but must be supervised by a responsible adult at all times. Parents or guardians assume full responsibility for the safety and conduct of minors during the charter.
Damage to the Yacht
Guests are financially responsible for any damage to the yacht, its equipment, or furnishings beyond normal wear and tear. Costs associated with repairs, replacements, or excessive cleaning may be deducted from the security deposit.
Compliance with Captain’s Instructions
Guests agree to comply with all instructions, rules, and safety guidelines provided by the captain. The captain’s decisions regarding safety, navigation, and onboard conduct are final.
Governing Law (Florida Law)
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.
Jurisdiction
Any disputes arising from or related to the charter or these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.
Force Majeure
The charter operator shall not be held liable for cancellations, delays, or changes resulting from events beyond reasonable control, including but not limited to severe weather, natural disasters, governmental actions, mechanical failures, or other unforeseen circumstances.
Media Consent (Photos & Video)
By participating in the charter, guests grant permission for photographs and video recordings taken during the charter to be used for promotional, marketing, and social media purposes, unless written notice is provided prior to departure requesting otherwise.
